DesignBay - Terms & Conditions

Welcome to DesignBay. These Terms & Conditions (“Terms”) govern your use of https://designbay.ae (the “Website”) and our subscription-based design services (the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.
1. Service Overview
DesignBay provides subscription-based graphic design and creative services. Subscribers can submit design requests and receive deliverables in accordance with their active plan.
We may update, modify, or discontinue any part of the Service without prior notice, provided that such changes do not materially reduce the quality of services promised under your current subscription term.
2. Eligibility
You must be at least 18 years old to use our Service. By using the Service, you confirm that you have the legal capacity to enter into these Terms.
3. Subscription & Payment
- All fees are charged in AED (United Arab Emirates Dirham) unless otherwise stated.
- Subscriptions are billed in advance on a monthly, quarterly, or annual basis depending on the selected plan.
- Payments are processed securely through third-party payment providers.
- Plans automatically renew unless cancelled prior to the next billing date.
- We reserve the right to adjust pricing with at least 14 days' notice.
4. Design Requests & Delivery
- Requests must be submitted through the designated communication channels.
- We process requests in the order they are received unless otherwise agreed.
- Standard turnaround time is typically a few business days per request, depending on complexity.
- Urgent requests may be accommodated based on workload availability.
5. Revisions
- All plans include unlimited revisions within the scope of the original request.
- Major changes that significantly alter the original brief may be treated as a new request.
6. Ownership & Intellectual Property
- Upon full payment, you receive complete rights to the final, approved designs.
- We reserve the right to display completed work in our portfolio and marketing materials unless you request in writing that we refrain from doing so.
- Any unapproved drafts, concepts, or unused designs remain the property of DesignBay.
7. Prohibited Uses
You agree not to use the Service or delivered designs for:
- Illegal, harmful, or offensive purposes
- Discriminatory or defamatory content
- Reselling unaltered designs without our written consent
8. Cancellations & Refunds
- You may cancel your subscription at any time.
- Cancellations take effect at the end of the current billing cycle.
- No refunds are provided for partial subscription periods.
9. Limitation of Liability
- To the maximum extent permitted by law, DesignBay shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service.
- Our total liability for any claim shall not exceed the total fees paid by you in the 3 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless DesignBay, its employees, and partners from any claims, damages, or expenses resulting from your use of the Service or breach of these Terms.
11. Third-Party Services
We may use third-party providers for payments, hosting, analytics, or communication. We are not responsible for their performance or policies.
12. Governing Law
These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai.
13. Changes to Terms
We may update these Terms at any time. Updates will be posted on this page with the revised effective date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
